New York Attorney General (AG) Letitia James recently announced her support for legislation that would significantly broaden the state’s consumer protection statute to prohibit not just deceptive acts, but also unfair and abusive business practices. The proposed Fostering Affordability and Integrity through Reasonable (FAIR) Business Practices Act, an idea long backed by leaders of the Biden-era Federal Trade Commission and Consumer Financial Protection Bureau, has been introduced in both the New York State Senate and Assembly.
The bill would modernize New York’s consumer protection law — originally enacted in 1970 — which currently only prohibits deceptive business conduct. Under the new proposal, both the Attorney General’s Office and individual consumers would be able to seek civil penalties and restitution from companies that engage in a wider range of conduct alleged to be harmful to consumers and businesses. That’s because the bill adds “unfair” and “abusive” practices to the types of behavior banned under state law. For example, a company that makes it extremely difficult for customers to cancel a subscription — without making any false or misleading statements — might not violate the current law, because the process, while frustrating, is not necessarily deceptive. But under the new bill, that same conduct could be considered “unfair” if it causes real harm to consumers, is difficult for them to avoid, and lacks a valid business justification.
James has framed the legislation as a tool to close enforcement gaps and better protect New Yorkers from evolving threats such as AI-enabled scams, junk fees, data misuse, and exploitative contract terms. The bill was introduced in the State Senate by Senator Leroy Comrie, a Democrat representing Queens, and is part of a broader effort to bring New York’s consumer protection framework in line with those of 47 other states which already authorize enforcement against unfair and abusive practices. The legislation has also received support from prominent former federal consumer regulators, who argue that stronger state laws are essential as federal enforcement capacity contracts.
Why It Matters
If enacted, the FAIR Business Practices Act could significantly expand the scope of business practices potentially subject to New York’s consumer protection law. Practices deemed unfair or abusive — even if they involve no misrepresentation — may now subject companies to regulatory scrutiny or private litigation. Not only will the AG have increased authority, but New Yorkers may also be able to obtain civil penalties and restitution/disgorgement if able to prove a violation of the act in court. While many consumer protection acts in most states cover unfair and abusive acts and practices, the new law is a reminder to companies who do business in New York to reassess compliance policies, customer service protocols, and contract terms through a broader risk lens to ensure that that the company’s business activities are defensible.
